Embroidery Disclosure, Terms, and Conditions

EMBROIDERY DISCLOSURE, TERMS, AND CONDITIONS 

ORDERING DISCLOSURE

  • We will proceed with your order once we have received the filled out order form, and this document is reviewed and then signed by the customer. This disclosure confirms that the customer acknowledges all of the agreements, notices, disclosures, and other communications The Cornea Co has provided below, on the filled sales order forms, and other communications in regards to the placed order. 
  • The Cornea Co is not responsible for any typographical mistakes or errors made by the customer that was approved by the original order, and approved by the customer from signing this document. In addition, The Cornea Co cannot be held responsible for any damages that may be incurred as a result of the error or mistake after the order has been embellished and accepted by the customer. The Cornea Co is also not responsible if the customer has a change of mind when the order has been submitted and agreed upon. 
  • Example: An order on a golf bag panel is supposed to read “Cornea”, but the customer approves the order with a typographical error on the order form that reads “CoReA,” The Cornea Co cannot be held responsible for the misprint and incorrect Capitalization as a result of the error from the customer. Once the customer approves the proof and order acknowledgment, we are not at liberty to make ANY changes to the order. Whether correct or with errors, an accurately fulfilled order will be printed exactly as approved by the customer order from either The Cornea Co Custom Bag Panel - Single Panel Order Form or The Cornea Co Custom Bag Panel - Multiple Panels Order Form. For this reason, it is VERY IMPORTANT to carefully look over ALL the information on the order forms before sending the order for approval.
  • As a privacy policy, we will not sell, trade or give your information to anyone not deemed by law.

TERMS AND CONDITIONS

CANCELLATIONS

  • All orders, once approved, are not available for cancellations on finished merchandise. Cancellations made prior to production are permitted, but may be subject to products already started on, digitizing service fee, and/or other supplies organized for the service. Rates may vary and are dependent on the cost of the supplies, time, and labor exhausted.

CUSTOMER RESPONSIBILITY

  • The Cornea Co customers are responsible for typing each name accurately within both lines of the ‘Panel Information’ section within either of The Cornea Co order forms. They are also responsible for selecting the correct panel option, font color, and font style. Before order approval all six elements of the ‘Customer Information’ section. To be submitted for approval, the ‘Customer Information’ section must include First Name, Last Name, Email, Phone Number, Order Form Submission Date, and Needed By Date. 

CUSTOMER SUPPLIED TEXTILE

  • The Cornea Co, at its discretion, will embroider on customer supplied textile. Please note that The Cornea Co will take the best possible care with supplied textile, however, any machine is subject to occasional malfunctions. The Cornea Co reserves the right to decline the acceptance of customer-supplied textile, if the product cannot be embroidered on effectively.

CUSTOMER EMAIL

  • When you provide us with an e-mail address or other contact information for the order, it is for the primary basis of communication for the order. We may use the information to occasionally notify you about special sales or services and other valuable updates to personalize your online shopping transactions with us. If you prefer that we not contact you in this manner, we will promptly remove you from our e-mail address list at your request. We will not sell, or share your information with anyone unless required by law.

LAUNDER-ABILITY AND SHRINKAGE

  • Some shrinkage is unavoidable on certain textiles with certain washing methods. To minimize shrinkage, follow washing instructions on garment labels. The Cornea Co is not responsible for shrinkage of garments.

PRODUCT, PRICING, AND OTHER SERVICE INFORMATION

  • Product that is left for more than 90 days without communication becomes property to the vendor.
  • Merchandise is sold at prices agreed upon the sales order forms. The Cornea Co reserves the right to adjust prices to reflect changes to your artwork, substituted garments, or other changes from the order form within the course of fulfillment.
  • Due to text conditions and custom customer variances, we cannot guarantee consistency in sizes to match perfectly  from order to order, color to color, or brand to brand. Contact us for sizing information if you are uncertain of the outcome of the embroidery work.

TRADEMARKS, LOGOS, AND COPYRIGHTS

  • All the logos and trademarks are registered trademarks and logos of their respective owners and copyright holders. They are provided only as a convenience for their lawful use, and should be used only by the owner of the logo or trademark, authorized agents or affiliates, with proper permission from the copyright holders.
  • Any customer of The Cornea Co represents and warrants to The Cornea Co that he or she has the unrestricted right to use, copy and distribute each copyright, trademark, service mark, trade name, logo, statement, graphic, artwork, name, photograph, portrait, picture or illustration of any person or any other intellectual property in the way it is to be printed on or otherwise applied to the merchandise ordered by the customer. 
  • All customers must agree to defend, indemnify and hold The Cornea Co harmless from any claims, suits or actions alleging that the merchandise ordered by the customer violates or infringes upon any rights of any third party.All customers are solely responsible for obtaining proper permissions and licenses from third parties whose rights may be violated or infringed. To use any logo, trademark or copyrighted items, a customer MUST have written permission from the owner of the logo or trademark or copyright, or be an employee or authorized agent or affiliate of the owner. A customer may NOT use any logo or other graphic material in a manner which may infringe copyright. A customer also may NOT use any logo or trademark in a vulgar, libelous, disparaging or otherwise unlawful manner. 
  • The Cornea Co assumes no responsibility for damages or any wrong doing that the customer may cause using a logo, trademark or copyrighted items. The Cornea Co shall not be held liable for the unauthorized, improper, or illegal use of any logo or trademark or copyright that is printed on or otherwise applied to merchandise ordered or purchased by the customer through The Cornea Co.The products shown are for demonstration purposes only. Actual product and color may vary slightly from what is displayed on your computer monitor. Virtual samples are not exact representations of your product, but intended to give you a good idea of what your finished merchandise will look like.While you own the right to control the use of your logo, all artwork and digitizing created by The Cornea Co remains the property of The Cornea Co. All electronic files created by The Cornea Co will remain the property of The Cornea Co for our exclusive use in executing your orders.Because it is our policy to render art services for production orders solely on a cost recovery basis, any transfer to the client of rights to creative works and materials prepared or contracted by our personnel is subject to reasonable release fees commensurate with the creative services rendered and at a value as determined solely by us.
